1) About HDP

HDP Network Solutions delivers end-to-end telecom construction and network implementation services across Ontario, including structured cabling, civil and outside plant (OSP) builds (underground and aerial), fibre splicing and testing, maintenance and restoration, and turnkey delivery for ISPs, data centres/headends, and multi-site enterprises.

2) Changes to These Terms

We may update these Terms from time to time to reflect changes to the Site, our services, or legal requirements. The “Last Updated” date indicates the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

3) Permitted Use

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Interfere with the Site’s security, performance, or availability

4) Quotes, Inquiries, Applications, and Submissions

If you submit a form, inquiry, quote request, resume, application, or other materials through the Site (“Submissions”):

• You represent that the information you provide is accurate to the best of your knowledge
  
• You acknowledge that HDP may use your Submission to respond to your request, evaluate opportunities or applications, or administer our business relationship
  
• You understand that Submissions are not confidential unless we explicitly agree otherwise in writing

5) Intellectual Property

The Site and its content (including text, graphics, logos, images, layouts, and other materials) are owned by HDP or used under license and are protected by applicable intellectual property laws.

You may view, download, and print pages for your internal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works, publicly display, or otherwise exploit Site content without our prior written permission.

6) Third-Party Tools and Links

The Site may reference or use third-party tools or services (for example, spam prevention, analytics, or form security services). HDP does not control third-party websites or services and is not responsible for their content, security, or practices. 7) Disclaimer (No Warranties)

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, HDP disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

8) Limitation of Liability

To the fullest extent permitted by law, HDP and its directors, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising from or related to your use of (or inability to use) the Site.

If HDP is found liable for any damages, our total liability will be limited to the greater of:
(a) CAD $100, or
(b) the amount you paid to HDP (if any) for the specific Site-related service that gave rise to the claim.

Nothing in these Terms limits rights that cannot be excluded under applicable consumer protection laws.

9) Indemnity

You agree to defend, indemnify, and hold harmless HDP and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms or misuse of the Site.

10) Suspension and Termination

We may suspend or terminate your access to the Site, without notice, if we reasonably believe these Terms have been violated or if required to comply with legal obligations.

12) Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of laws principles. You agree that any dispute will be brought in the courts located in Ontario, Canada, unless applicable law requires otherwise.
